Greetings on this blessed Sabbath Day (Sunday):
May your memories of Memorial Day leave your heart grateful for the sacrifices of so many of our beloved brave men and women of the United States Military. May this be the year Americans finally resolve to never let those acts of bravery be thought to have been in vain. It is now or never.
Below is my article which is lengthy; however, it contains information I believe to be a matter of life and death for America and her citizens.

When the Lord God is on the case, who can stop his called, appointed, anointed? If Barack Hussein Obama really knew the God of America, he would never have dared to take on his course of action to try to dictate to this free people who should and who should not stand in the place of the Lord to God’s people in God’s House. And, so, we enjoin this battle! No man or woman can dictate to God’s beloved that they must forego God’s word, will, and way to conform to a “new” way set for them by any man or woman. I declare and decree that The Gates of Hell have written their names on the furnace door who dare to push God out of America and, indeed, the world. Come to the line. And, if you don’t see one then make this that line you refuse to cross.

Overall, We the People have fully come to that point where the battle cry must be, “We Will Not Obey!” Look at what is happening across this world to a people who refuse to be further enslaved, while in America we have long ago tasted of freedom. In fact, a close look at the United States Constitution tells us that it is Barack Hussein Obama, a stranger in our midst, who is pushing against all that we know to be patriotic, constitutional, Godly, and just. It is he who has shown no respect for either the Office of the President, the Constitution, the rule of law, God, or citizens; and, his minions have without let up, followed suit to create havoc, chaos, and confusion all across this nation and the world. Even as our brave men and women at home and abroad continue to give their all to protect and defend America, Obama is doing all he can to destroy this nation, with impunity and without accountability. Who keeps watch?!

Congress is asleep at the switch and, I believe, it may have something to do with the fact that Obama is a black man and they don’t want to be labelled as racists and haters, if they actually did their job and held him to the strict accountability for pursuing what no other black man in America can lay claim to, which is, the honor and privilege of serving as the leader of the free Western world. Instead, Obama has abused and misused his position of authority via his ongoing treasonous attempts to create for himself a brand new nation from the ground up by tearing down every vestige of the Constitution created by our forefathers and for which so much patriot blood is shed and many prayer-filled tears fall to keep whole and wholly Holy. It must no longer stand to be the case that Godly patriotic citizens will stand around and watch as Obama forces America to crumble without their steadfast intervention. Keep America Proud!

For decades, organizations and individuals have fought to see who had the greatest and best of all hoard of followers and the largest coffers. Still they beg and call for more money. Well, there is no more money and it is time to demand that they unite forces and resources and take action. They have taken all the money. Sucked this nation dry. And still they watch and tsk as Obama and the progressives change America into Socialism, Islamism, Communism, Secularism, and everything else but what she is, and which everyone who is in elected office has pledged an oath or given an affirmation “to protect, preserve, and defend.” Ours is a representative democratic REPUBLIC thriving off of God, capitalism, and a free people who know the difference between living right and living wrong.


People can stand around meeting, eating, greeting, and repeating if they want to, but surely some solutions ought to be in hand by now. It is time to enact them. Instead, they watch as Obama is continuing to lie and deny and convince people that he can fix America when it is he who has fully contributed to her breakdown in the first place — whether from behind the scenes or right into the face of her citizens.

The politicos won’t tell it. The news moguls won’t spread it. The so-called learned academicians won’t teach it for fear of losing their tenure, salaries, pensions or status. Too many Preachers won’t stand to declare it for fear of being left on the outside. Well??? In the meantime, people are dying and losing hope and faith, as all of this passing the buck goes on all around them. They can find no relief from government agencies and elected officials who have shut off their phones and closed down snail mail and email to all but people whose situations they feel can get them on the front pages and national television and radio news of the few who will carry it. They have forsaken America but God hasn’t.


Not too many people will take lightly knowing that steps have been taken by the Obama Administration Department of Health and Human Services (DHHS), under the leadership of him and Kathleen Sebelius, to enact policies and regs to force volunteer hospital Chaplains and volunteer On-Call visiting Clergy to reveal confidential talks they have when meeting with patients and even that they must also include family members in their hospital rooms at the time of the visit.

Simply put, this means that many hospital Pastoral Care Departments across this nation are making it mandatory that Chaplains and On-Call Clergy write on hospital-prepared forms information from patients’ charts and disclose what the patient talked about with them. Keep in mind that this is to be done after the confidential patient-clergy visit. Moreover, your hospitalization could very easily place you in this dilemma without regard for those HIPAA privacy forms you will be asked to sign upon admission along with the Do Not Resuscitate.

At Johns Hopkins Hospital Howard County General Hospital (JHH-HCGH) (MD), Rev. Stephen Mann, director, Pastoral Care Department, told me, “They’ll (patients) tell you what they won’t tell US!” To which I replied, “That’s why, as a member of the Clergy, I won’t use that form.” I considered it a violation of clergy-patient confidentiality and a gross violation of the HIPAA Act. Of course, they disagreed and had conspired to use a pretext to terminate my more than 20 years service there as a visiting and Volunteer On-Call Clergy (of 30 years). In fact, the hospital reported to DHHS-OCR that I was the only On-Call Clergy who was terminated in the history of the hospital. I have been in this New City community since before that then new facility was open to the public as a hospital. Before then, it was Columbia Medical Plan (Howard County, MD). What’s more, I was one of a handful of Clergy who, around 1986, served on the committee formed to explore starting a Chaplaincy Program at that hospital.

Now, hospitals are threatening clergy and other people of faith that they should either conform to their new hospital regulations and policies (which actually come down from Washington, D.C.) or else face loss of their hospital privileges (i.e., terminated and kept out). Are you kidding me?! Not at all. What is happening is dangerous and it is very serious. I learned through the DHHS-OCR investigation report that the hospital is making room for Muslims to enter Pastoral Care. I have served in community ecumenical services many times for special occasions. However, this move by the hospital is purely to not offend the Muslim population by Christianity and, specifically, the name of Jesus in their hearing. It is an attempt on their part to shut out our faith, period. And, thereby, to usher in Shariah Law right under our noses. The American people of God and like-minded citizens as one body reject that attempt, because Muslim leaders have let it be known they will take America, Israel, and the World!

The episode that brought me face to face with the Department of Health and Human Services – Department of Civil Rights (DHHS-OCR) began in March 2009. I had published in this forum that account about how I had been unceremoniously terminated at that time. And, as a result of the hospital’s non-response about what my next step should be, I searched the internet and filed complaints with DHHS-OCR. That experience was also very telling.

I filed complaints in 2009 and heard nothing back until April 2012, when I received a 6-page investigation report from DHHS-OCR informing me that their investigation into my JHH-HCGH complaint was complete. It was only by the footnote that I learned my HIPAA complaint had been closed on November 3, 2009, without any action. But, then the report went on to disclose what the hospital witnesses had reported to the investigator as pertains to the hospital’s reasons for terminating my services in March 2009. To my surprise, those witnesses from the hospital had committed perjury and fraud by deliberately, knowingly and willfully lying to the investigator during a federal investigation into my 2009 complaint. The DHHS-OCR had not contacted me during the course of that investigation and, therefore, I had no opportunity to respond to their report before it was sent to me; but, it did state that I had 30 days from receipt of that report in which to respond to it.


April 2012, After I had received and read that DHHS-OCR report, I phoned the investigator and told her that I planned to respond and that the witnesses accounts were not true and that they had lied about me. The investigator, Ms. Krumm, then told me that (lying) didn’t make any difference during an investigation, because she was only going to review the case based on “new” information they did not already have in their files on my case. And, further, she told me, “You can respond, if you want to, but the case has been (considered) closed.” Remember, the report I received gave me 30 days from receipt to respond.


From the outset (in March 2009) when Rev. Stephen Mann, director, had told me for the first time I had been complained about in October 2007, I denied having behaved in an inappropriate way at that time or any other time. There had been no complaints about my service. It was used as a pretext for Rev. Mann to snatch my badge and to terminate me as a Volunteer On-Call Clergy. Yet, that same false allegation was included in the DHHS-OCR report and more devastating accusations against me were added to it. None of it was true and they knew or should have known it, because they were in that 2007 luncheon presentation room the same time I was.

During the DHHS-OCR investigation, I was not contacted and neither was the Professor who had given her presentation at that October 2007 luncheon.

The DHHS-OCR report states, in part,

(quote) “According to Mr. Jack Dunlavey, another Pastoral Care volunteer, when the guest speaker began to explain the fundamentals of Islam, the complainant stood up, made a comment, noisily gathered her belongings, and “stalked out” of the room. The complainant agrees that she left the meeting early, but states that others had left early, as well, and denies that she left in a loud or rude manner. Rev. Mann states that he heard the complainant mutter, “No one is going to convert me into a Muslim,” in addition to additional unintelligible comments as she left. The complainant states that Rev. Mann did not address these allegations with her, and that she made no such comments.” (unquote)

I continue to maintain I never did as those witnesses alleged. Anybody who knows me knows I do not mutter, sputter, stomp, or stalk. I am known to be straightforward with anything I disagree or even agree with. None of those alleged statements had entered my mind much less to act on them in that setting. I continue to maintain those allegations were false and used as a pretext for the hospital to shut me out — merely because, as the DHHS-OCR investigator’s report said, the hospital said that I was the only Clergy in Pastoral Care who had refused to fill out their mandated patient-clergy visitation form and that all others in Pastoral Care had done so. [That DHHS-OCR investigation report is available for anybody who might want to see it or discuss it with me, but it is too extensive to include here.]


On May 12, 2012, I submitted my timely response to the DHHS-OCR. A few days later, I again phoned the JHH-HCGH to request copies of any complaints against me, if any. JHH-HCGH Legal, Rev. Mann, and the hospital Human Resources Department gave me the runaround and no information. They wouldn’t even give me the name of the Professor or tell me where she was from. Even though it was close to five years from their alleged incident, which didn’t surface from them until March 2009, they should have had that still on file. They have made light of my spiritual life as a Christian Cleric, but just this past week, it was truly the Holy Spirit who showed me where my own original copy of that specific flier announcing the October 2007 Pastoral Care Luncheon was in my files and the Holy Spirit led me to that copy after my much searching had failed to uncover it. It looked brand new. What a happy day that was!

I then contacted the Professor, and her response told me in one day what I had been saying to Rev. Mann and hospital officials all the time. The Professor’s response to me proved that REV. STEPHEN MANN AND CHAPLAIN DUNLAVEY, had deliberately, knowingly, and willfully lied about me to a DHHS-OCR investigator (perjured themselves). The Professor had confirmed to me, in an email of her own volition, that she had remembered that day and her October 2007 presentation, but she had no memory of anybody there behaving inappropriately during that time. She also sent me an email stating that she had given her presentation and had left. (I had left before the Professor’s talk had ended, but it was not in the manner those Clergy witnesses said.)

My files are replete with documentation which will enable me to carry this fight to the frontlines, because no God-called Clergy will compromise and capitulate with the Obama Administration’s unlawful and unconstitutional edicts and mandates and phony, fake, false, regulations and vocal decrees they use in an attempt to force Christians, Catholics, and Jews, into the ungodly realm of diversity and perversion and all things contrary to the will of God, the United States Constitution, and commonsense! Either HIPAA stands to protect privacy or it doesn’t, but patient-clergy confidentiality in no wise shall ever be infringed by government and, it shall not be — not by me.

Our lives are literally on the line. Health professionals who have morals are leaving their posts rather than to harm patients. And health professionals who have no moral compunctions about lying in regards to matters of importance cannot be trusted with the oversight of our health or that of our family, friends, and strangers, too. They know the Obama Administration has set into place the groundwork for nonprofessionals to turn the health industry into a commercial enterprise and, depending on who can come up with the money, will dictate who will live and who will die. Because, they plan to eventually make that decision!! Let it not be so.

The newspapers won’t tell it. Television reports won’t show it. Radio punsters won’t. Except, my friend, Dr. Laurie Roth, radio host and 2012 Candidate for U.S. President, is bold enough to let citizens know exactly what is going on in this nation and how she has solutions to resolve the ills. It doesn’t take a whole lot of money or masses of people to make a difference. And I will shout it from the rooftops that citizens must give the devil no more ground. Obama cannot illegally and unconstitutionally confiscate rights and then demand a free people to obey his wrongs just because he is in the Oval Office and believes he can legislate by Executive Orders and by use of Judicial fiats. Not so! And, if you want to sleep in peace in America and the world, it is past time people said NO!

I am not behind. I’ve been up ahead waiting for the others to catch up. Join me.

Hon. Janet, Museveni’s wife the next President of Uganda

Now it is clear that President Museveni, when he retires, will be succeeded by his wife, Janet who is now MP and Minister for Karamoja affairs.

She is a strong politician, seen by many as a candidate not to be ignored, having been in the centre of power for 26 years during her husband’s rule.. President Museveni has proposed her as successor and it is believed that very few people in the party will dare refuse to pull their socks in the right direction – supporting Museveni’s wishes.

If she will be challenged, Museveni himself may decide to stay on for another term. This will force politicians to support Janet in order to get their wish of removing President Museveni from power.

Janet, taking over the Presidency, will ensure that Museveni retires comfortably without harassment of any kind.

Obama must not win second term in Office: This is one election we cannot afford to lose,” says Corsi. – His Birthplace must be revealed

Sheriff Joe Arpaio’s Cold Case Posse is closing in on Obama’s deceptions about his birth certificate, about his Selective Service registration card, about his life leading up to the White House.

The problem is everyone on Sheriff Arpaio’s Cold Case Posse is volunteering their time.

With the investigation entering a critical seventh month, key volunteers on the Cold Case Posse will have to drop out unless funds can be provided to substitute for the income they need to support their families.

Dr. Jerome Corsi has agreed to devote his corporation, Constitution Consultants LLC — a company he set up to help fund his investigative research — to be 100 percent devoted to supporting Arpaio’s Cold Case Posse volunteers, so the work of investigating Obama can continue without interruption.

Because Constitution Consultants is a New Jersey limited liability corporation, all donations must be after-tax and reported by Corsi to the IRS. The advantage to contributors is that contributions can remain anonymous because federal and New Jersey tax laws do not require disclosure of individual donors, as long as all donations are reported — a condition Corsi has a history of scrupulously meeting.

From now until the election in November, Corsi has committed to apply the donations he receives in Constitution Consultants to making sure he and the Cold Case Posse can pursue Obama until the last facts about Obama’s identity and his eligibility to be president are uncovered and made public.

“This is one election we cannot afford to lose,” says Corsi. “If Obama wins re-election, the fundamental freedoms our Founding Fathers defined under the Constitution are at risk of being lost. If Obama wins re-election, the very free enterprise system that has built the strongest middle class the world has ever known will be undermined in Saul Alinsky rhetoric of barely disguised class warfare.”

Eurovision song contest’s Losers and Winners: Norway at the bottom, Sweden at the top.

Eurovision contest in Azerbaijan, 27th, May 2012;

Sweden defeats all contestants, becoming the top with 372 points. Loreen sang beautifully and won the souls of the voters. The big loser this year is Norway with only 7 points. Last year when Germany was the organizers, Norway represented by Kenyan born Stella Mwangi failed to reach the finals, while a representative from Azerbaijan became victorious resulting in this year’s event taking place in that country. This year, Norway was once again represented by a non-ethnic norwegian.

Next year’s arrangement will take place in the winning country, Sweden

Where is Azerbaijan?

Azerbaijan, officially the Republic of Azerbaijan is the largest country in the Caucasus region of Eurasia. Located at the crossroads of Western Asia and Eastern Europe, it is bounded by the Caspian Sea to the east, Russia to the north, Georgia to the northwest, Armenia to the west, and Iran to the south. The exclave of Nakhchivan is bounded by Armenia to the north and east, Iran to the south and west, while having a short borderline with Turkey to the northwest.

Azerbaijan has an ancient and historic cultural heritage. Aside from having been the first Muslim-majority country to have operas, theater and plays, Azerbaijan today is among the Muslim-majority countries where support for secularism and tolerance is the highest. The Azerbaijan Democratic Republic, the first democratic and secular republic in the Muslim world, was established in 1918, but was incorporated into the Soviet Union in 1920. Azerbaijan regained independence in 1991.

The northern Sudanese border states of Blue Nile and South Kordofan are on

This should not come as a surprise.  For many months now warnings of
famine, and diseases consequent upon malnutrition, have become increasingly urgent. 

The devastating effects of bombing attacks during the planting season in the Nuba Mountains quickly became apparent last spring: following the June 5 outbreak of hostilities between Khartoum’s Sudan Armed Forces (SAF) and the indigenous northern rebel group, the Sudan People’s Liberation Movement/Army-North (SPLM/A-N), aerial assaults on villages, fields, and livestock became relentless.  A terrible reprise of these attacks on civilian livelihoods began in Blue Nile on September 1.

Some 150,000 people have already fled South Kordofan and Blue Nile for
Ethiopia or South Sudan, which itself is facing potentially catastrophic food insecurity, deliberately exacerbated by many of Khartoum’s actions. Conditions in the camps in Upper Nile, where most of the refugees from Blue Nile have fled, are appalling and unsustainable. 

The refugees themselves, who continue to flee in large numbers, are the best indicators of conditions for those who remain in the war zone, many too young or too feeble to make the exhausting trek southward.

IRC reports that some children show signs of “severe malnutrition”; Oxfam
declares its sense that “we’re on the path from crisis to catastrophe”; and Save the Children puts the issue most broadly: “A toxic combination of conflict, rising food and fuel prices, and severe cash shortages is having a devastating effect on the civilian population in both countries. With the rains on the way the situation could not be more critical.”

Tom Catena, the only Western physician working in the Nuba, wrote to me
recently declaring: “The food shortages now are very severe.  No one seems
to have any food stock left and there’s absolutely nothing to buy in the market. We have a small stock here that we’re preserving for our staff and in-patients and are hoping to make it through the rainy season.  

Most people are eating leaves and these pod-like things from the trees” (email rec’d May 20, 2012).  Even more terrifyingly, people are widely reported to be eating their seed stocks, ensuring that there will be nothing for the current planting season—or a harvest next fall.

But again, there is nothing surprising in what we are seeing. By October 2011 the UN’s Food and Agriculture Organization had predicted that harvests would largely fail in Blue Nile and South Kordofan. By November the Famine Early Warning System Network (FEWSNet) was warning that near-famine conditions would be seen by March without humanitarian relief. 

Currently health workers are warning of “devastating epidemics” for lack of vaccines for children and other critical medical supplies. Reports from a wide range of humanitarian sources make unavoidably clear that many hundreds of thousands of lives are at acute risk.

And yet in UN Security Council Resolution 2046 (May 2, 2012) the Council
can bring itself to do no more than “strongly urge” that Khartoum allow
humanitarian access.  Despite the Chapter 7 authority of the resolution, it
ignores the regime’s obduracy in the past, and its consistently demonstrated willingness to use the denial of humanitarian assistance as a weapon of war: in the Nuba Mountains in the 1990s, during the long civil war in the South, and currently in Darfur. 

The Council resolution points to the access proposal made jointly by the African Union, the UN, and the Arab League in early February—a proposal the SPLM/A-N quickly agreed to. 

Predictably, Khartoum declares it is still “studying” the joint proposal; and almost four months later has succeeded in delaying any action until this year’s heavy seasonal rains have begun.

This forces a question the international community has either skirted or
denied any legitimacy: should humanitarian corridors be opened without
Khartoum’s consent if the only alternative is to watch hundreds of people
slowly starve to death?

As the dying continues, the question will only become more exigent.

Infection control at home

KISUMU,  – Elsie, Bernard and their five children share a tiny tin-walled single room in Nyalenda, an informal settlement in Kisumu, in Kenya’s Nyanza Province. They are both infected with HIV and TB.

“We can’t infect them [children] with HIV that easily unless something bad happens, but we know if we don’t take care, we could give all of them TB,” Elsie, told IRIN/PlusNews.

Studies show that children are likely to acquire TB infection from adults living in the household as well as those having a relationship with them or the family but living away.

Good hygiene practices are an important component of TB infection control and prevention, but maintaining them is not easy in an informal settlement, where houses are crammed together and sanitation facilities hard to come by.

Regular hand-washing, good ventilation, and coughing and sneezing away from other people are all useful tools in TB prevention. Through a community-based organization, Hygiene at Home, Elsie and her family have been receiving lessons on how to have good hygiene in their household.

“When the house is this small, even if you sneeze or cough away from the rest, that ‘far away’ is still close – you can’t help it. We have no proper toilets, and water is scarce and you can’t use the little available to wash your hands all the time,” Elsie said.

“Now I make sure I have some water in my house just for hand-washing, and I have a tin where my husband and I can spit sputum and close it again tightly… the children are a little safer,” she said.

Peninah Sewe, the coordinator of the Hygiene at Home initiative, told IRIN/PlusNews that if TB infections in informal settlements were to be contained, proper hygiene was vital.

“Hygiene in health facilities is emphasized, but little is done to promote hygiene amongst TB-infected households, which is important. People living in poor conditions must be helped to keep good hygiene within their homes,” she said. “Providing people with handkerchiefs, giving them antiseptics or soap to take home might appear small-time gestures, but are very important in keeping infections under control.”

Through a network of volunteers, Hygiene at Home contacts households in informal settlements in Kisumu and educates them about how to prevent the infection from spreading.

“We teach them how to sneeze and cough in a way that protects the person closest to them. We also teach them how to use small amounts of water to ensure good hand hygiene,” Sewe told IRIN/PlusNews.

Kenya is ranked at 13 on a list of 22 countries with the highest TB burdens in the world, and has the fifth highest burden in Africa.

Senior government officials say they recognize the need to improve prevention methods in tandem with treatment programmes.

“As we step up treatment programmes, we might hit a brick wall when we don’t promote measures that help in curtailing new infections or re-infections, because… our treatment programmes are strained,” Joseph Sitenei, director of the National Leprosy and TB Control Programme, told IRIN/PlusNews.

Global-warming policies and the threat to U.S.

Contrary to what Defense Secretary Leon Panetta told an environmental organization earlier this month, the threat to America’s geopolitical standing comes not from global warming but from anti-energy global warming policies, according to free market policy analysts and national security advocates.

During an annual reception held for the Environmental Defense Fund at the Smithsonian American Art Museum in Washington, D.C., Panetta described how abrupt environmental changes could unsettle populated areas and create international tension.

“The area of climate change has a dramatic impact on national security,” Panetta said at the reception. “Rising sea levels, severe droughts, the melting of the polar caps, the more frequent and devastating natural disasters all raise demand for humanitarian assistance and disaster relief.”

While it is possible for climate change to foster instability in certain areas of the world, updated scientific research indicates that the claims are greatly exaggerated and must be carefully weighed, Marlo Lewis, a senior fellow with the Competitive Enterprise Institute, has warned.

He cites a detailed study published in the official journal for the British Science Association that finds there has not been a single instance of a declared war fought over international fresh water sources over a period of five decades. Instead of fighting over water, the countries collaborate and import “virtual water” in the form of grain, the report says.

In response to Panetta’s talk, Marc Morano, the editor of Climate Depot, points out that the scientific rationale for restrictive energy policies has been greatly discredited in the past few years. He cites the unfolding “climategate” scandal, that has implicated the Climate Research Unit at the University of East Anglia in Britain. Emails leaked from CRU demonstrate how researchers manipulated and distorted scientific data when they could find no evidence of man-made global warming.

“Aside from the fact that the ‘national security’ angle rests on speculative doomsday scenarios, perhaps the biggest whopper of the new movement is the implication that we must pass the congressional climate bill to ‘address’ or ‘remedy’ the problem and thus ‘avoid’ future wars and loss of life,” Morano said. “Left unanswered in this argument is how a climate bill that will have no detectable impact on global temperatures will help ‘solve’ the alleged looming national security threat.”

Instead of fixating on dubious environmental claims, the CEI scholar Lewis has suggested that Defense officials shift their focus over to the national risks that could result from climate change policies.

“Today’s U.S. Army is the most fuel-intensive in history, and the Defense Department is the nation’s largest consumer of fossil fuels,” Lewis wrote in a policy paper.

Therefore, he said, it should interest the Defense Department that cap-and-trade programs are designed to “make fossil fuels more costly.”

The policies green pressure groups have advanced on Capitol Hill, and at the state level, are rooted in a regulatory concept known as the “Precautionary Principle,” Lawrence Kogan, CEO of the Institute for Trade Standards and Sustainable Development, a non-profit legal research group, explained in an interview.

The Precautionary Principle, as it is defined by environmental groups within the European Union and the United Nations, calls for the suspension of any proposed activity or enterprise until after environmental allegations are satisfied, even if a cause-and-effect relationship has not been scientifically established.

In his explosive new book of that title, Sussman details how what he calls “green authoritarianism” was inevitable from the beginning. He explains that Richard Nixon, who “wanted to be liked,” according to one of his well-known former advisers, created the Environmental Protection Agency as an olive branch to the hard left. “The same fear-based, anti-corporate and luddite mindset that has been so destructive to European companies and economies has been incorporated into the EU Commission international trade policy and systematically exported to America and the world,” Kogan said. “Nothing less than America’s free enterprise system, individual freedoms and international interests – its core political and economic values – are at stake.”

Nowhere is the Precautionary Principle more entrenched and deeply embedded than within the Law of Sea Treaty. Secretary Panetta made the case for ratification during his talk.

“We are the only industrialized nation that has not approved that treaty,” he lamented.

Panetta views the treaty as a way to clear up disputes concerning navigation rights.

But opponents like Kogan and Frank Gaffney, president of the Center for Security Policy, are concerned that the treaty will transfer U.S. sovereignty to the authority of foreign tribunals, which will rule on U.S. seabed mining and military transportation.

“The innocent passage of U.S. nuclear-powered military vessels,” write Kogan and former Navy secretary J. William Middendorf, could be stymied by lawyers claiming hypothetical environmental risks.
