Vice President survives in the new government coalition deal in Kenya – Raila Odinga wil be answerable to Kalonzo Musyoka of ODM-Kenya

kibaki.jpg<President Mwai Kibaki at the top. He retains the presidential powers. Kibaki will continue to rule Kenya and ensure prosperity for all. He was not going to relinquish power to anyone. He wants to continue serving the Kenyan people while occupying the highest seat in the land.

kalonzo.jpg<Vice President Kalonzo Musyoka of ODM-Kenya, second in command reports to the President. He is therefore the man who assumes power should the President fall sick and that is the way Kalonzo will build himslef up in preparation for next presidential elections.

This is the reality in the coming Kenyan politics. The line of Power in Kenya and who is answerable to who.

The Vice President’s seat held by Kalonzo Musyoka of ODM-Kenya remains untouched in the new coalition deal struck between the Government and Raila’s ODM. Kalonzo will remain answerable to the president mwai Kibaki. Under the Vice President is probably going to be Raila Odinga if he takes the Prime Minister post, with Mwai Kibaki the president on the top. 

PNU’s Kibaki and ODM’s Raila Odinga have finally agreed to work together.

Many, however, fear the same may happen again where they did not mange to work together when they formed Narc during Kibaki’s first presidency.

The country is yet to see laws changed to clear the way for the coalition.

ODM got the coalition and not transitional government as they had insisted. They will also have to live with Vice President Kalonzo Musyoka who remains the country’s vice president answerable to the President and not to the Prime Minister once created.

parliament has now been recalled so that they may enact the necessary laws that will pave way for a coalition to function.

PNU and ODM will also get the opportunity in the new agreement to share ministerial positions.

One deputy prime minister will come from each side.

The prime minister will come from ODM while the Presidency with the real presidential powers will remain with Kibaki assisted by ODM-Kenya’s Kalonzo Musyoka.

It now remains to be seen whether the arrangement will be delayed and also if at all it can function as expected.

If the deal goes on well, the Kenyans may now be able to breath clean and go ahead with their lives.

If ODM was to get the presidency, Raila had promised William Ruto the seat of the Prime Minister. Musalia Mudavadi was to get the Vice Presidency. Now things are different. Many are watching to see what Ruto and Mudavadi will get in the new deal.

    Wole wangu Ruto, could you have gone all those miles in vain. If Musalia misses it won’t be the first time he is missing a promised slot. in 2002, he got contented with missing the VP after backing Uhuru. But for Ruto who has sacrificed all he has, missing it may just prove too expensive. I just hope at the end of it we shall have a government that represents every tentacle of the Kenya republic.

    This a shock. I thought the vp ìs to be non-existent. raila has not got far. If he becomes prime minister and nr 3 in line of power, he is just like any other minister. Am sure PNU and ODM-Kenya ministers will never listen to Raila. Only his ODM ministers

    To janam, Does it occur to you that PNU and ODM-Kenya ministers wil listen to raila, a number 3 in power after Kalonzo the vp? Those ministers including Karua and others wil not even notice raila. They wil deal directly with the president.No win for raila

    Listening is one thing,being supervised is another.Even ODM ministers will not listen to Kibaki and he wont sack them at will.
    Am happy we have peace and no one has won.

    Just forgot to tell you this…kalonzo has a coalition agreement with Kibaki which has caused a division in ODM-K even before this new arrangement. Imagine PNU and ODM in a 50-50 power sharing arrangement…wat will kibaki give KANU,NAK-K,ODM-K,FORD PEOPLE,SAFINA name it.
    Nobody has won and nobody has lost,we only want peace as we prepare ourselves for a complete overhaul of the constitution…and dont forget what the kamba MPs told kalonzo at the start of the week.
    I wish the new constitution will allow for the appointment of the ministers from non-MPs…that they may remain as law makers and not policy implementors.

    Key points: Kenya power-sharing deal
    Kenya’s President Mwai Kibaki and opposition leader Raila Odinga have signed a power-sharing agreement which will see the creation of a prime minister post.

    Former UN Secretary General Kofi Annan, who mediated the negotiations, said the deal would be known as the National Accord and Reconciliation Act, and “entrenched in the constitution”.

    He outlined the key points of the agreement as follows:

    # The post of prime minister will be created, with the holder having the authority to co-ordinate and supervise the execution of government functions.

    # The prime minister will be an elected member of parliament and the parliamentary leader of the largest party in the National Assembly, or of a coalition if the largest party does not command a majority in parliament.

    # Two deputy prime ministers to be appointed, one to be nominated by each member of the coalition.

    # The prime minister and deputy prime ministers can only be removed if the National Assembly passes a motion of no-confidence with a majority vote.

    # A cabinet to consist of a president, vice-president, prime minister, two deputy prime ministers and other ministers.

    # The removal of a minister of the coalition will be subject to consultation and agreement in writing by the leaders.

    # The composition of the coalition government will at all times take into account the principle of portfolio balance, and reflect the parties’ relative parliamentary strengths.

    # The coalition will be dissolved if the current parliament is dissolved; or if the parties agree in writing; or if one coalition partner withdraws from the coalition.

  9. The agreement was signed by two people to safe the Kenyans from violence. What some of us are suposed to do is to pray God to bring Kenyans together in a true unity.Kibaki and Raila are the only two people who signed the agreement deal for the sake of Kenyans

    Therefore there is no way of Kalonzo’s name or any other member arising in the deal.Let us face the reality of the matter and unite Kenyans.

    READ the agreement and you will appreciate who is answerable to whom. i guess there is no option to this.
    if someone is supervising you, then you are answerable to them.

    if Kalonzo retains his ministerial position, then he will be supervised by Raila.

    we are also assuming that Karua will be retained in the cabinet. i hardly think so.
    ask yourself why she was uneasy with the fact that the cabinet as presently constitutde will be disoolved and new appointments made.

    Shortly after signing the deal, the President Kibaki quickly exercised his powers to reconvene parliament next Thursday, an exercise which will eventually seek to entrench the “coalition government deal” into the constitution. That could be a nice move in a game of political chess. Watch out!

    The current parliament was summoned by the president “prior” to the “coalition deal”. In issuing orders to reconvene parliament this coming Thursday, Emilio Mwai Kibaki simply exercised the powers he already had before. Since he retains the powers of the office to “reconvene” and/or “dissolve” parliament, he can just as easily dissolve parliament whenever he chooses and the coalition deal with ODM will effectively be “dissolved”. Remember only PNU and ODM are parties to the coalition, the other parties like Musyoka’s ODM-K can still continue to work with PNU to retain the status quo,…and LO and BEHOLD, the country shall surely be plunged into chaos again!! My advise: Let us not celebrate too quickly until such-like loopholes are fixed in parliament. CHEW ON THAT…

    Who will ODM choose as Deputy PM?
    What need to be done to resolve the issue of houses nyakuad by some people in Narobi, these happen to be ODM followers , will ODinga tell them to vacate the homes they have moved into?
    will this not cause chaos
    this maybe a trivial issue to some but to others its major

    THE NATIONAL ACCORD AND RECONCILIATION ACT 2008

    Preamble:
    There is a crisis in this country. The Parties have come together in recognition of this crisis, and agree that a political solution is required.

    Given the disputed elections and the divisions in the Parliament and the country, neither side is able to govern without the other. There needs to be real power sharing to move the country forward.

    A coalition must be a partnership with commitment on both sides to govern together and push through a reform agenda for the benefit of all Kenyans.

    Description of the Act:
    An Act of Parliament to provide for the settlement of the disputes arising from the presidential elections of 2007, formation of a Coalition Government and Establishment of the Offices of Prime Minister, Deputy Prime Ministers and Ministers of the Government of Kenya, their functions and various matters connected with and incidental to the foregoing.

    1. This Act may be cited as the National Accord and Reconciliation Act 2008.

    2. This Act shall come into force upon its publication in the Kenya Gazette which shall
    not be later than 14 days from the date of Assent.

    3. (l) There shall be a Prime Minister of the Government of Kenya and two Deputy Prime Ministers who shall be appointed by the President in accordance with this section.

    (2) The person to be appointed as Prime Minister shall be an elected member of the National Assembly who is the parliamentary leader of –

    (a) the political party that has the largest number of members in the National Assembly; or
    (b) a coalition of political parties in the event that the leader of the political party that has the largest number of members of the National Assembly does not command the majority in the National Assembly.

    (3) Each member of the coalition shall nominate one person from the elected members of the National Assembly to be appointed a Deputy Prime Minister.

    4.(1) The Prime Minister:
    a) shall have authority to coordinate and supervise the execution of the functions and affairs of the Government of Kenya including those of Ministries;
    b) may assign any of the coordination responsibilities of his office to the Deputy Prime Ministers, as well as one of them to deputise for him;
    c) shall perform such other duties as may be assigned to him by the President or under any written law.
    (2) In the formation of the coalition government, the persons to be appointed as Ministers and Assistant Ministers from the political parties that are partners in the coalition other than the President’s party, shall be nominated by the parliamentary leader of the party in the coalition. Thereafter there shall be full consultation with the president on the appointment of all Ministers.

    (3) The composition of the coalition government shall at all times reflect the relative parliamentary strengths of the respective parties and shall at all times take into account the principle of portfolio balance.

    (4) The office of the Prime Minister and Deputy Prime Minister shall become vacant only if -
    (a) the holder of the office, resigns or ceases to be a member of the National Assemb1y otherwise than by reason of the dissolution of Parliament; or

    (b) the National Assembly passes a resolution Which is supported by a majority of
    all the members of the National Assembly excluding the ex-officio members and of which not less than seven days notice has been given declaring that the National Assemb1y has no confidence in the Prime Minister Or Deputy Prime Minister, as the case may he; or
    (c) the coalition is dissolved.

    (5) The removal of any Minister nominated by a parliamentary party of the coalition shall he made only after prior consultation and concurrence in writing with the leader of that party.

    5. The Cabinet shall consist of the President, the Vice- President, the Prime Minister, the two Deputy Prime Ministers and the other Ministers.

    6. The coalition shall stand dissolved if:
    (a) the Tenth Parliament is dissolved; or (b) the coalition parties agree in writing; or
    (c) one coalition partner withdraws from the coalition by a resolution of the highest decision-making organ of that party in writing.

    7. The prime minister and deputy prime ministers shall be entitled to such salaries, allowances, benefits, privileges and emoluments as may he approved by Parliament from time to time.

    8. This Act shall cease to apply upon dissolution of the tenth Parliament, if the coalition is dissolved, or a new constitution is enacted, Whichever is earlier.

    PRESS RELEASE BY HER EXCELLENCY MRS. LUCY KIBAKI, THE FIRST LADY OF THE REPUBLIC OF KENYA

    As a Kenyan who is desirous and committed to the evolution of principled politics in our country, I would like, with all due respect, to register my most solemn protest against leaders who dishonestly accuse and insult our head of state. I take particular exception of the persistent and unwarrated attacks that the MP for Mwingi North, Hon. Kalonzo Musyoka has continued to level against the President.

    On more than one occasion, Hon. Kalonzo Musyoka has attacked our President unnecessarily blaming him for the misfortunes that has befallen our country. For a man who claims to profess the Christian faith, it is very disappointing that Kalonzo can insinuate that the President was responsible for the drought that has affected not only Kenya but also other parts of the horn of Africa, especially Ethiopia, Somalia and Djibouti. It is equally disturbing that a trained lawyer who should be conversant with the logic of cause and effect can attribute other misfortunes that have befallen the country to the President.

    Sometime ago, Kenyans will recall, Hon. Kalonzo Musyoka claimed that it was him who advised President Kibaki to adopt and implement the policy of free primary education. As Kenyans are fully aware, the policy of free primary education had already been clearly articulated in the NARC manifesto at a time when Hon. Kalonzo Musyoka was a diehard supporter of the KANU regime. More recently, even after the fallout with the NARC Government, Hon. Kalonzo Musyoka had the temerity to claim that he advised President Kibaki to declare the food insecurity situation in drought-affected areas a national disaster. This again was a barefaced falsehood. Kenyans will again recall, with much dismay that during the referendum, Hon. Kalonzo Musyoka claimed that the Proposed New Constitution had been written with a view to blocking him from vying for the Presidency. Needless to say, this was a lie intended to mislead would be his supporters into rejecting the constitution.

    While we sympathise with Hon. Kalonzo Musyoka’s bleak Presidential ambitions, it is very important that he desists from undermining our President and insulting the intelligence Kenyans. Kenyans are now politically mature enough to know that falsehoods are an aspect of cheap propaganda. Kenyans also know that claiming credit dishonestly is also cheap propaganda. At the level of the political awareness of the people of Kenya, Hon. Kalonzo Musyoka should be advised that he cannot win his way to the Presidency through lies, rhetorical posturing and credit claiming. The Presidency is a seat of integrity and one cannot throw decency through the window and expect the vote of the people.

    Indeed, Hon. Kalonzo Musyoka should be advised that Kenyans do not forget so easily and they will certainly put him on the carpet during national presidential debates, to show cause why they should elect him President. In future, Kenyans will only be electing leaders who have a demonstrable track record of development during their time in Parliament. If the truth be told, Hon. Kalonzo Musyoka has been in Parliament for a long time, yet Mwingi Constituency that he has represented, remains among the most marginalized in Eastern Province. In spite of being a cabinet minister for a long time, his constituency has lagged behind. There are no credible projects that he initiated to uplift the living standards of his constituents.

    Kalonzo’s call to President Kibaki to apologise to Kenyans is but sheer nonsense and a show of great political mediocrity. There is nothing wrong that our President has done to warrant him to apologise. As all Kenyans are aware, the President is serving the country well. He has also upheld the integrity befitting the Presidency. Indeed, throughout his political career, President Kibaki is not known to trade abuses or tell lies.

    Indeed, if Kenyans need apologies, those apologies should first come from Kalonzo and all those in LDP, especially the former ministers who had been destabilising the NARC Government from within. The NARC Government would have achieved much more than it has done within the last three years if Kalonzo and others supported the President. Instead, they all went out of their way to undermine the Government’s development agenda. For this great disservice, we Kenyans need Kalonzo’s apology.

    At this time when people everywhere in the world are demanding honesty, probity and transparency in Government, Kalonzo should tell Kenyans whether indeed, he is a born-again Christian as he claims. In the light of the lies he has pedalled around, and his unjustifiable insults on our President, Kenyans have a right to doubt.

  16. To be frank His Excellency the Vice-president of the Republic of Kenya has done the coutry proud by choosing to team up with the existing government in the time when the ODM fraternity were calling for mass action to protest that the elections were rigged.
    Kalonzo,for sure is a calm leader who is not greedy at all for leadership and has proved himself to be a people’s servant and not a political leader.I recommend Hon.Kalonzo to be given the mandate to lead the nation after PRESIDENT KIBAKI.Raila should therefore honour allegiance to Kalonzo MUSYOKA.

Raila without any doubt cannot work with President Kibaki at all costs and if signs of the same happens,kenyans should not be proud.Raila cheated the LDP luminaries to ditch NARC and join the opposition and instead of correcting the government,they kicked off the 2007 general elections campaign at the expense of development.He even went further to play a game to our Vice-president by lining up all the ODM luminaries to show their interest in the presidency.Kalonzo was booed at Khadija Primary School in Mombasa an event which was organised.RAILA IS A PRETENDER IN POLITICS AND SHOULD NOT BE ENTRUSTED TO FORM ANY COALITION GOVERNMENT OR FORM ANY ALLIANCE.CHOOSE KALONZO AND ALL WILL BE WELL IN KENYA.
